Frequently Asked Questions

Clear Answers for Complex Real Property Matters

Working With EMH Law

What types of clients do you typically represent?

I primarily represent real estate developers, brokers working with development clients, sophisticated HOA and condominium boards, and financial institutions. My practice focuses on complex real property matters rather than on general legal services.

Do you represent individual homeowners?

My practice is limited to real property matters involving development, governance, zoning, and transactions. I do not represent individual homeowners in disputes against their HOA, nor do I handle landlord-tenant matters.

Do I need a real estate attorney for a development project?

While Colorado law does not require you to retain counsel for every development step, most projects involve zoning approvals, contractual structuring, entity formation, and regulatory compliance. Early legal involvement often prevents delays and costly restructuring later.

Engagement & Process

What happens during the initial consultation?

We will discuss your matter, your objectives, and the practical realities of the project or dispute. If the issue aligns with my practice, I will outline the next steps and provide an engagement agreement.

How do you communicate with clients?

I communicate directly with my clients by phone and email. As a solo practitioner, you work directly with me throughout your matter.

How long do matters typically take to resolve?

Timelines vary depending on the complexity of the issue and whether governmental approvals or litigation are involved. Many transactional and governance matters can be resolved within weeks, while regulatory or contested matters may take longer.

Fees & Billing

How are fees structured?

Fees depend on the nature and scope of the matter. Most work is handled on an hourly basis. During our initial consultation, I can provide an estimate based on the anticipated scope of work.

Do you accept online payments?

Yes. Invoices can be paid securely online, and checks are also accepted.

Geographic Scope

What areas of Colorado do you serve?

I represent clients throughout Colorado, with significant experience across the Western Slope, including Aspen, Montrose, Grand Junction, Mesa County, Ridgway, Ouray, and surrounding communities.

Do we need to meet in person?

In-person meetings are available, but many matters can be handled efficiently by phone or video conference.

Fit & Strategic Questions

How do I know if my matter is too complex?

If your issue involves zoning interpretation, easements, entity structuring, HOA governance, development approvals, or high-value transactions, it likely warrants the services of experienced real property counsel. Complex matters often benefit from early strategic evaluation.

Do you handle litigation?

I handle dispute resolution related to real property matters. When litigation is necessary, I provide representation or coordinate strategically depending on the scope of the case.
